Jayana Webb, 22, of Eagleville, appeared in court Wednesday for a preliminary hearing on the March 21 accident. Charges of third-degree murder were dropped due to lack of evidence, according to the judge. He is still facing charges of homicide with a DUI vehicle, negligent homicide and other related offenses. “I think at the end of the day the judge made the right decision under the law. He should never have been charged with murder,” said Webb’s lawyer, Michael Walker. Shortly after the hearing, the Philadelphia DA’s office re-filed third-degree murder charges in the case. Authorities say Webb was driving I-95 south of Milepost 18 near the Stadium Complex just north of Broad Street when he struck and killed 33-year-old Martin F. Mack III and 29-year-old Branden T. Sisca. Oliveras also died in the accident. Nine witnesses testified during Wednesday’s preliminary hearing. Prior to the deadly collision, Webb was reportedly driving about 110 mph and was pulled over by the two soldiers. It was revealed in court that the soldiers abandoned Webb when they received a call for a pedestrian on the highway. Then, 15 minutes later, authorities say Webb fell on soldiers and infantry. Webb told the soldiers that she looked at her phone to see which way she was going when she heard a “boom”. Her blood alcohol level was 0.211% and Webb was seen in a watch video being deflected. The preliminary hearing ended with great frustration between the family and colleagues of the fallen Pennsylvania State Police soldiers, Mac and Siska. Webb’s lawyer said he could understand why they might be upset. “They want a lawsuit to represent them very well and to represent the lives of people who have been lost, and I’m not sure they think they got it,” Walker said.
